Client work product

Upon full payment for services rendered, clients receive ownership rights to the final deliverables as specified in the project agreement. We retain the right to use completed projects in our portfolio and marketing materials unless otherwise agreed in writing.

5. Payment terms

Payment terms are as follows:

• Invoices are due within 14 days of the invoice date unless otherwise specified
• Late payments may incur a fee of 1.5% per month or the maximum allowed by law
• We accept payment via bank transfer, credit card, or other agreed-upon methods
• All prices are quoted in EUR or PLN unless otherwise agreed in the project contract
• Prices do not include applicable taxes unless specifically stated

Project timelines are estimates based on the scope of work and client cooperation. While we strive to meet all deadlines, timelines may be affected by factors including scope changes, delayed feedback, or unforeseen technical challenges. We will communicate any timeline changes promptly.

7. Refund and cancellation policy

Our refund and cancellation policy is as follows:

• Clients may cancel projects with written notice at any time
• Cancellation fees will apply for work completed up to the cancellation date
• Refunds are issued at our discretion and based on the work completed
• No refunds are provided for completed deliverables that meet the agreed specifications
• Deposits and retainer fees are non-refundable

8. Warranties and disclaimers

We warrant that our services will be performed in a professional and workmanlike manner. However, our services are provided "as is" without any other warranties, express or implied. We do not warrant that our services will be uninterrupted, error-free, or meet all your requirements.

9. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services. Our total liability shall not exceed the amount paid by you for the services in question.

We respect the confidentiality of our clients' information. We will not disclose any confidential information shared with us during the course of our engagement, except as required by law or with your explicit consent. We may require clients to sign a separate Non-Disclosure Agreement (NDA) for sensitive projects.

11. Indemnification

You agree to indemnify, defend, and hold harmless Tomasz Kisiel Software and its owner, contractors, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of our services or violation of these terms.

Our services may include or rely on third-party services, tools, or platforms. We are not responsible for the availability, functionality, or terms of these third-party services. Your use of third-party services is subject to their respective terms and conditions.

13. Modifications to terms

These Terms are governed by and construed in accordance with the laws of Poland. Any disputes arising from these terms or our services shall be resolved by the competent court having jurisdiction in Poland.
